Note: The GymOS Member App is for gym members. Additional features for gym owners and administrators are available through the GymOS web platform at thegymos.app.
1. Acceptance of Terms
By accessing or using the GymOS platform or mobile application (“Service”), you agree to be bound by these Terms and Conditions (“Terms”). If you are accessing the Service on behalf of a business or organisation, you confirm that you have the authority to bind that entity to these Terms.
If you do not agree to these Terms, you must not access or use the Service. Continued use of the Service following any update to these Terms constitutes acceptance of the revised Terms.
2. Definitions
- “GymOS”, “we”, “our”, “us” — the GymOS platform and the team that operates it, accessible at thegymos.app and through the GymOS mobile application.
- “Service” — the GymOS web platform, mobile application, and all associated features, dashboards, and tools made available to users.
- “Customer” or “Gym Owner” — a gym operator or business entity that has been approved and onboarded to use GymOS.
- “Admin” — a staff member of a Customer granted administrative access to a gym account within the Service.
- “Member”— an individual gym member who accesses the Service through a Customer’s gym account, including through the GymOS mobile application.
- “Customer Data” — all data, content, and information submitted to the Service by a Customer, their Admins, or their Members.
3. Description of Service
GymOS is a gym management and member engagement platform that provides gym owners and operators with tools to manage their operations, and provides gym members with a mobile application to track attendance, workouts, progress, and membership details.
Access to the Service for gym owners is granted only through an approved onboarding process. GymOS reserves the right to approve or decline any access request at its sole discretion. Access to the mobile application for gym members is available through the member’s registered gym.
4. Mobile Application
The GymOS Member App is available for download on iOS and Android. By downloading and using the app, you agree to these Terms in addition to the terms of the applicable app store (Apple App Store or Google Play Store).
The mobile application enables gym members to:
- Connect to their gym by scanning the gym’s QR code or entering a gym code
- Mark daily attendance via QR check-in at the gym premises
- Track workouts, fitness progress, and body metrics
- View personalised workout recommendations and meal planning suggestions
- Upload and share progress photos and a profile picture
- Participate in an in-gym social community feed, including liking and commenting on posts
- Follow other gym members and manage follow requests
- View a gym-wide leaderboard based on personal workout records
- Report inappropriate content or block other members
- View membership details, invoices, and renewal information
- Receive notifications related to gym activity and membership
Certain features of the mobile application require device permissions (camera, photo library, notifications). These permissions are requested at the time the relevant feature is first used and may be managed through your device settings at any time.
5. Account Registration and Security
To use the Service, users must register an account. You are responsible for:
- Providing accurate, complete, and current information during registration
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Promptly notifying GymOS at support@thegymos.app if you become aware of any unauthorised access
You must not share your credentials with others or allow unauthorised users to access the Service through your account.
6. Account Deletion
Members have the right to delete their account at any time directly within the GymOS mobile application under Profile → Delete Account.
- Deactivation: Upon requesting deletion, all active sessions are immediately terminated. A 30-day recovery window begins, during which the member may log back in to restore their account fully.
- Permanent Deletion:If the account is not reactivated within 30 days, the member’s personal data will be permanently deleted. Financial records, invoices, and transaction data may be retained as required under applicable Indian law including the Companies Act and GST regulations.
- Reactivation: Logging back in during the 30-day window will automatically restore the account and cancel the scheduled deletion.

7. Subscription and Billing (Gym Owners)
Access to GymOS for gym owners is provided on a subscription basis. The following terms apply:
- Fees: Subscription fees are due in advance of each billing period as specified in your plan. All fees are in Indian Rupees (INR) unless otherwise stated and are non-refundable except as required by applicable law.
- GST: All applicable Goods and Services Tax (GST) will be charged in addition to the subscription fee in accordance with Indian tax law.
- Renewals: Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
- Price Changes:GymOS will provide no less than 30 days’ advance notice of any material price changes.
8. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service for any purpose that is illegal, fraudulent, or harmful to others
- Upload or transmit any content that infringes intellectual property rights or violates any person’s privacy
- Attempt to gain unauthorised access to any part of the Service or any other user’s data
- Use automated tools to access or extract data from the platform without written authorisation from GymOS
- Introduce malicious code or otherwise interfere with the operation of the Service
- Reverse engineer or attempt to derive the underlying technology of the Service
- Use the Service in a manner that places an unreasonable load on our infrastructure
- Upload or share any content that is obscene, defamatory, harassing, or violates any applicable law
- Impersonate any person or misrepresent your affiliation with any person or entity
GymOS reserves the right to investigate suspected violations and suspend or terminate access without prior notice where necessary.
9. User Content and Community Features
Members may upload progress photos, profile pictures, and other content to the Service, and may interact with other gym members through the social community feed. By uploading or posting content, you confirm that you own the content or have the right to share it, and you grant GymOS a limited licence to store and display the content within the Service solely for the purpose of delivering the features you have requested.
Progress posts and photos shared to the in-app community feed are visible to other members of the same gym according to your privacy settings. You may set your account to private, control your follow requests, and delete your posts at any time from within the app.
Leaderboard data, including your name and personal workout records, may be visible to other members of your gym. You may contact your gym administrator or GymOS support if you have concerns about this visibility.
GymOS does not share your photos or posts outside the platform or use them for any advertising purpose.
Content Moderation
GymOS provides tools for members to report inappropriate content and block other members. Reports are reviewed by gym administrators and the GymOS team. GymOS reserves the right to remove content that violates these Terms or applicable law, and to suspend accounts engaged in harmful or abusive behaviour.
10. Customer Data and Ownership
You retain full ownership of all Customer Data submitted to the Service. GymOS does not claim any ownership rights over your data. By using the Service, you grant GymOS a limited, non-exclusive licence to store and process your Customer Data solely as required to provide and maintain the Service.
You are solely responsible for the accuracy and legality of Customer Data you submit, including any personal data of gym members or staff.
11. Intellectual Property
The GymOS platform, including its design, features, branding, and content, is owned by GymOS and protected under applicable Indian intellectual property laws. These Terms do not grant you any rights in the GymOS platform or brand beyond the limited right to use the Service as described herein.
12. Data Privacy
Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. By using the Service, you agree to our data practices as described in the Privacy Policy. GymOS complies with the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023.
13. Third-Party Communications (WhatsApp)
Where a gym has enabled WhatsApp-based messaging and a member has provided their WhatsApp number, GymOS may facilitate the delivery of gym notifications and membership updates via WhatsApp using Meta’s Business API. Members may opt out of such communications by contacting their gym administrator or GymOS support. Use of this feature is subject to WhatsApp’s terms of service.
14. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or uninterrupted availability. GymOS does not warrant that the Service will meet your specific requirements or that it will be free from errors at all times.
GymOS does not provide any fitness, medical, dietary, or health advice. Content generated or tracked through the platform (including workout logs, BMI calculations, and meal suggestions) is for informational purposes only and should not be relied upon as professional health guidance.
15. Limitation of Liability
To the maximum extent permitted by applicable Indian law, GymOS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, loss of data, or business interruption, arising out of your use of the Service.
GymOS’s total aggregate liability to you shall not exceed the total fees paid by you to GymOS in the twelve months immediately preceding the event giving rise to the claim, or INR 5,000, whichever is greater.
16. Indemnification
You agree to indemnify and hold harmless GymOS and its team from any claims, liabilities, damages, and expenses (including reasonable legal costs) arising from: (a) your use of the Service in violation of these Terms; (b) your Customer Data; or (c) your violation of any applicable law or third-party rights.
17. Service Availability and Modifications
GymOS aims to provide a reliable service but does not guarantee uninterrupted access. Scheduled or emergency maintenance may temporarily affect availability. GymOS reserves the right to modify or discontinue features with reasonable notice where practicable.
18. Termination
- By you (Gym Owners): You may cancel your subscription by contacting us at support@thegymos.app. Cancellation takes effect at the end of the current billing period.
- By you (Members): Members may delete their account at any time from within the GymOS mobile app as described in Section 6.
- By GymOS: We may suspend or terminate access immediately if you breach these Terms, engage in conduct that poses a security risk, or fail to pay applicable fees.
Upon termination, your right to access the Service ceases. Customer Data export requests must be made within 30 days of termination. After that period, data may be deleted in accordance with our retention practices.
19. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be subject to the exclusive jurisdiction of the competent courts located in Chennai, Tamil Nadu, India.
20. Changes to These Terms
GymOS may update these Terms from time to time. We will notify Customers and Members of material changes by updating the “Last updated” date on this page and, where appropriate, by email or in-app notification. Your continued use of the Service after updated Terms have been posted constitutes acceptance of the revised Terms.
21. Entire Agreement and Severability
These Terms, together with the Privacy Policy and any separate written agreements between GymOS and the Customer, constitute the entire agreement between the parties regarding the Service. If any provision is found to be unenforceable, the remaining provisions will continue in full force and effect.
